The real estate industry has closely followed one of the CFPB’s 2013 case against a Kentucky law firm, Borders & Borders, PLC. The case is critical to many settlement-service providers: What must an affiliated-business arrangement do to comply with RESPA Section 8? Is the ten part sham test really dead?  Are the Borders cases likely to be followed outside the 6th Circuit (KY,MI, OH, TN)?   What does this all mean for Real Estate agents and brokers, mortgage lenders, title agents, and other settlement service providers?  Last year, the trial court in Borders gave one answer in ruling for the defense, but then recently changed its reasoning, leaving industry insiders confused about what lessons can be gleaned from those decisions. This webinar will explore those lessons, and will also give valuable insights into whether and how Borders affects their operations.
